1. About traaacks!

traaacks! is operated by Dar Golan, a sole proprietor based in Berlin, Germany. By accessing and using traaacks.com ("the Service"), you accept and agree to be bound by these terms. If you do not agree, please do not use this service.

2. Description of Service

traaacks! provides a platform for streaming and downloading royalty-free music tracks and stems created by Dar Golan. We offer both free (Essential) and premium subscription tiers with different access levels and download limits.

3. User Accounts and Registration

To download music or access premium features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information during registration.

4. Subscription Plans and Billing

Essential (Free): 3 downloads per month of free tracks only.
Premium: 100 downloads per month including premium tracks and stems. Available monthly (€5) or annually (€55).

Subscriptions automatically renew unless cancelled. Cancellation takes effect at the end of the current billing period. The download limit resets at the beginning of each billing cycle and cannot be exceeded by the system.

5. Music License and Usage Rights

All music on traaacks! is owned by Dar Golan. When you download a track, you receive a royalty-free license that grants you the right to:

• Use the music in personal and commercial projects
• Use the music in videos, podcasts, presentations, and other media
• Distribute your final projects containing the music
• Use the music in projects for clients or employers

You may NOT:

• Resell, redistribute, or sublicense the music itself
• Claim ownership of the music or register it under your name
• Use the music in ways that compete directly with traaacks!
• Share your download links with others

6. Project Submissions

Users may submit projects using our music for potential feature on our homepage. By submitting, you grant us permission to showcase your project and confirm you have the right to submit all included content. We moderate all submissions before featuring them.

7. Refund Policy

Subscription refunds may be considered on a case-by-case basis for technical issues or exceptional circumstances. Refund requests must be submitted within 14 days of payment to support@traaacks.com with detailed reasoning.

8. Prohibited Conduct

You agree not to: violate any applicable laws, attempt unauthorized access to our systems, distribute malicious software, abuse our download limits through technical means, or engage in any activity that could harm the Service or other users.

9. Data Backup and Service Availability

We maintain comprehensive backups of our platform and user data. While we strive for high availability, we do not guarantee uninterrupted service and are not liable for temporary outages or data loss.

10. Limitation of Liability

The Service is provided "as is" without warranties. To the maximum extent permitted by German law, Dar Golan shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

11. Governing Law and Disputes

These terms are governed by German law. Any disputes will be resolved in the courts of Berlin, Germany. For EU residents, you retain the right to pursue claims in your country of residence.

12. Changes to Terms

We may modify these terms with 30 days' notice via email or platform notification. Continued use after changes constitutes acceptance. Material changes affecting your rights will require explicit consent.
